Product Warranty

Scynce LED LLC (“Scynce”) warrants that for a period of five (5) years for light fixtures and one (1) year for all other products (“Products”) measured from the date of shipment (“Warranty Period”), the Products will conform to specifications published by Scynce for each Product in effect as of the date of shipment of the Product (“Specifications”). All Specifications are based on LM80 data sheets from their respective LED chip manufacturers. This translates into Scynce warrantying that during the Warranty Period the light will maintain at least 80% of its original light output and that no more than 10% of the LEDs will fail.

With respect to any Product confirmed by Scynce as not conforming to its respective Specification during the Warranty Period (“Defective Product”), Scynce will, in its sole discretion, repair or replace the Defective Product free of charge.*  Legacy models (prior to Kush, Kale and Dragon Alpha fixtures) sold by predecessor entity will be serviced on a best efforts basis, and parts for repair may not be available.  In that case a warranty credit equal to the depreciated value of the fixture will be offered for upgrade to a new or refurbished fixture.  depreciated value is calculated on a straight line basis over 60 months from the original purchase date and price.

Scynce will pay all shipping and handling fees associated with the repaired or replaced Defective Product anywhere within the continental United States of America if the RMA is initiated within the first 180 days from purchase.   If the RMA is initiated between 181 and 365 days from purchase, Customer pays the shipping to Scynce and Scynce pays shipping to customer.  After the first year following purchase, customer pays shipping both ways for repairs.  All shipping outside the continental U.S.A. will be at Buyer’s expense. The Warranty Period is not extended for repaired or replaced Products.

PRODUCT DAMAGE FROM VOLTAGE FLUCTUATION, EXCESSIVE VOLTAGE, VOLTAGE SURGES / SPIKES, LIGHTNING ETC. IS NOT A “DEFECTIVE PRODUCT”.  SCYNCE STONGLY ADVISES ALL USERS TO USE APPROPRIATE SURGE PROTECTION AT A FACILITY (TYPE 1 AND 2) AND CIRCUIT LEVEL (TYPE 3).  REPAIRS FOR OVER VOLTAGE DAMAGE WILL BE HANDLED ON A TIME AND MATERIALS BASIS AT CUSTOMER’S EXPENSE.  IF A CUSTOMER CAN DEMONSTRATE APPROPRIATE FACILITY AND CIRCUIT VOLTAGE SURGE PROTECTION WAS IN PLACE AND A REVIEW OF A VOLTAGE TEST STUDY SHOWS POWER WITHIN SPECIFIED VOLTAGE RANGE, THEN SCYNCE WILL REPAIR OVER VOLTAGE DAMAGE FREE OF CHARGE.

EXCEPT FOR THE LIMITED PRODUCT WARRANTY ABOVE, SCYNCE MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCTS, INCLUDING ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; (C) WARRANTY OF TITLE; OR (D) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.

This Limited Product Warranty also does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow Product instructions; (e) modifications; (f) unauthorized repair; (g) normal wear and tear (including powder coat); (h) external causes such as accidents, abuse, or other actions or events beyond Scynce’ reasonable control. This Limited Product Warranty is non-transferable and does not apply to Products whose original ownership cannot be verified.

Buyer must: (a) obtain a Return Merchandise Authorization (“RMA”) number either by calling 480-256-0017 or requesting an RMA via email at [email protected] during the Warranty Period; (b) ship the Product prepaid to Scynce at 4641 E. Ivy St., Mesa, AZ 85205; (c) include a copy of the original invoice or product registration (“Documentation”); (d) clearly mark the RMA number on the Documentation and on the outside of the packaging used for shipment; and (e) include a description of the non-conformity specifically relating to a performance parameter associated with the Product’s Specification (“Defect”) and the date of occurrence of the Defect (“Defect Date”), along with the Buyer’s physical return address (no P.O. Boxes) and contact information to include, at a minimum, Buyer’s phone number and email address in order to request warranty service.**

THE REMEDIES DESCRIBED ABOVE ARE BUYER’S SOLE AND EXCLUSIVE REMEDIES AND REPRESENTS SCYNCE’ ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. SCYNCE’ LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY BUYER FOR THE DEFECTIVE PRODUCT, NOR SHALL SCYNCE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

*Certain replacement options may require a credit card hold based on the current MSRP of the replacement item.  100% of the replacement item’s MSRP will be charged to Buyer’s credit card in the event that Buyer fails to return the defective Product within fourteen (14) days of receipt of the replacement.

**Scynce reserves the right to revoke any previously authorized RMA due to damage caused to the Defective Product by inadequate return packaging or if Scynce determines that the RMA authorization occurred more than fourteen (14) days prior to the return of the Defective Product.
